Into 5,083 posts, some wank must fall

Well, it's 5,082 posts now... :) Gotta say that today's now-deleted post is the first of its kind that we've ever seen in this community. And dickish as it was, one post out of 5000+ is not even a blip on the meter.

For those who didn't see the post and wonder what's up, someone who rounded up a bunch of fics that are no longer available for sharing in this community, decided she'd create a new username expressly to upload said fics to an individual 4Shared page and then posted the link here in the comm.

As we've said repeatedly, what anybody chooses to save to their own hard drive and share privately is not and cannot be any of our business, but *in this community*, we go by the rules that have been posted. There aren't many, but one rule that is if an author ever notifies the maintainers that they have pulled their fics and they ask specifically that sharing *within the comm* be disallowed, we will abide by that author's request.

So far, the only author who's done so is jans_intentions. niquita_gia is the author who notified us today of this now-deleted post and has made a similar request regarding her fic, which we will honor.

As far as Carly's "That Darn Gus" fic, no such request has been made. Apparently, she posted her fics to bjfic.net and they were made unavailable because that archive has been dead for over 18 months now and the current owner chooses not to release it for someone else to step up and maintain. But if the archive came back online, that fic and many others would be available once more.

This should answer any questions regarding the wee bit of drama that is now over and done with. Carry on reading and searching and being the awesome comm members that you all are!

Im sure she never meant no harm & lets face it lots of us have fics saved to our H/Drives that we can post to whom ever we wish, the Internet & the LJ is a big place.

Second, I'm sure she did mean to stir shit up. Her post clearly said (paraphrasing since it's been deleted) "fuck it. I know this is going to get deleted so grab'em while they're hot."

As you say, and as we've said repeated, whatever anyone chooses to save and share outside the community is totally your own business. We do not care at all. We just care about following the guidelines that have been in place for several years and keeping this community the friendly, generous, fun place it is.

She violated not only the letter of the comm, she violated the spirit of the comm. On purpose.

To be honest I never saw any of that, I didn't even click onto the post, I just read the names of the fics & I knew who they belonged to & I knew you guys would be pissed off, but I went to bed & missed all the action:)

Re: bjfic.net.. Do you happen to know when the last time someone asked was, and the reasoning behind not giving it up? I really enjoyed it, and it just seems like such a waste to have it sitting there, only unusable to do disinterest from the maintainer. I'd love to look into taking it over.

When the original owner of the site had RL issues and couldn't maintain it any longer, she asked for someone to take it over. Cael is the one who responded to that request. Now that she seems to have RL issues of her own, I don't understand holding the site hostage and making excuse after excuse after excuse for heading on two years rather than offering it up for someone else to manage. I feel confident that there are numerous people who would volunteer to step up, get the funds together for hosting, and get it back online.

I don't know how you do that, but it can't be that big a deal since there are hundreds of fannish archives around, most of which are NC-17 inclusive.

Carly, aka _mournthewicked, I don't think would have a problem with it. The reason they aren't available on LJ is because her hard drive crashed before she made the post, and now they are lost in the oblivion. I've saved the few she did manage to post in my memories, but I would encourage people to ask her! Maybe then she'd finish the last one.

I had an off line conversation with her regarding a typo, and she said that she wasn't planning on deleting them, but she wasn't going to go back and fix them either.

I saw that post last night and thought *OMG Court is going to have a conniption fit when she see's this*.

When I saw it last night I had a good opportunity to snag some stories of hers but then I realized that *hey, she doesn't want those out*. So I stopped myself from doing it.

I respect when people when they take their stories down but if I pass on the story through PM then that's different. I hope I can trust the next person to not post them online.

The issue with Jan's stories being in book form is that people want to read the original form, ie Brian and Justin as main characters. She's not the first person to re-work fanfic into original fic, though, and she won't be the last. It's a little weird to read a story that you've read in a different form, though. I haven't read Jan's, but another author that I've known for a long time. I think the difference there was that it was RPS fic, so the switch of names wasn't quite so jarring. Just...odd.

As we've said here before, what people do outside the comm with regard to sharing fic is beyond our reach, and out of our control. I'm sure some people downloaded the fics while they were up. That's their business. The issue was someone coming in with the expressed intent to start shit. We're not having that. That person has been banned, as will anyone else that tries to pull a stunt like this again.

Well, we have a difference of opinion on that front. Writing fanfiction, which is by definition based on characters you do not own and then removing those fics so the characters can be renamed and the stories then sold as original fiction for which an author is financially compensated seems ethically challenged at best, outright stealing at worst.

I am not saying Jan did this. I don't know because I have only read a couple of her fics and none of her books. But "they've been taken offline and she's asked they not be shared because she's reworking them into original fiction" is the reason everyone cites when anyone asks why her fic is unavailable.

My personal opinion, or anyone's personal opinion, doesn't matter, however, since the original maintainers of this community implemented the rule about not sharing in the community if an author so requests. That rule, and the fact that the original poster was so obviously trying to stir up drama, is why the post was deleted.

Is this the That Darn Gus fic? And if so, is there anywhere else to find it? I tried the mournthewicked journal link below but it says access denied. Now I'm more curious than ever to read these stories!

No, I don't think so. The post has been deleted and I don't remember the exact words but it was pretty much:

"Fuck it. I'm tired of looking for fics for hours and hours and now that I've found them, I don't give a shit if they're not supposed to be shared. I'm sharing them anyway. You guys better grab them while you can before the moderators delete this."

That's a paraphrase, but not by much. The only fics she uploaded were a half-dozen or so of Jan's, one of niquita_gia's, and the Gus one of Carly's. There are a lot of people with 4Shared or Megaupload or SendSpace accounts who offer their links when someone is looking for a fic. We don't have any problem with that. In fact, there's a Tag named "personal DL link" or something like that.

This poster today was purposely and purposefully trying to create drama and had to create a new LJ just so she'd have a user name to post from. She may disagree with the policy here about not sharing if an author asks, and she's welcome to her opinion. She can go create her own comm if she wants, she can't pull her shit here, which she knew, and she did anyway.

People can and have gone to public file storage places for fic and music all the time. I go looking for songs on occasion. That's not something we can or would even try to control. We can only do that here, where we've been asked to do so.

I saw the post last night, and resisted the temptation to download any of the stories, despite never having read any of them. Can't say I didn't want to, because, well, some of these fics get mentioned so often that I can't help but be curious, but I love this community and can't support people who deliberately flout the rules and the wishes of its authors. So what I'm trying to say, really, is€€ good call mods. :)
