Brian has a younger bother who is slightly disabled and nobody knows about him (FOUND)

I'm looking for a fic I had read looong time ago and recently it came back to me in a dream...

Brian has a younger bother who lives in a special facility/clinic. He was born slightly disabled, because Joan was drinking while pregnant. Some events from Brian's childhood lead to the point where everyone (Brian's mother and sister) thinks the younger boy's dead, only Brian knows he's still alive and of course takes care of him from then on. But he keeps it a well hidden secret. Not even Justin and his friends know about the secret sibling.

I also remember that when the boy's existence is revealed, Brian's mother tries to fight Brian in court for custody. (of course it's about money not the boy's well being)

Anyone? Please, it just keeps me awake at night, because I can't recall the author ot the title. I checked the tags, nothing matches.
